USA is known for its extraordinary sophisticated medical care. Any Indian who is suffering from an incurable disease, thinks of going to USA for treatment there. But the reality is that high quality health care is not available to millions of people residing in USA.
The US Department of Health and Human Services states that one-third of the Metropolitan areas in USA have shortages of physicians. 34.9 million Americans live in health professional shortage areas. To-day 16,000 doctors, 8500 dentist, 4000 Mental Health Professionals and 1,26,000 nurses are needed in USA. This need is likely to increase to 50,000 physicians in the year 2010 and 2,00,000 in the year 2020. USA Immigration Laws however are such that despite hundreds of doctors and nurses from India and elsewhere in the world desirous to travel to USA to work there they find it difficult to do so.
Indian physicians have the following six immigration options to travel to USA:
1. On B-2 Visitors Visa
2. On J-1 Exchange Visitors Visa
3. On H-1B Specialty Occupation Workers Visa
4. On O-1 visas meant for persons with extraordinary ability.
5. On L-1 Visas meant for Intra Company Transferees, and
6. Through Labour Certifications.
Excepting people with extraordinary capabilities, who are eligible to receive O-1 visas, to receive either J-1, H-1B, L-1 Visas or Labour Certification, an Indian Physician is required to pass USMLE Step I, Step II CK (Clinical Knowledge), Step II CS (Clinical Skill) and Step III Exams as well as pass the Test of English as Foreign Language (TOEFL) Exam. Step II CS and Step III Exams can only be taken in USA. Thus in effect, to avail of the options to receive either J-1 or H-1B or L-1 Visa or Labour Certification an Indian physicians must first receive B-2 Visitor’s visa, which will allow him to enter USA and take Step II CS and Step III Exam there.
Our physicians spend thousands of rupees in preparing themselves for USMLE Exam but many of them are unsuccessful in receiving B-2 visa to travel to USA to take Step II CS and Step III Exams. Due to this many Indian physicians out of fear that their visas may be denied, when they apply for a B-2 visa, avoid to mention that they are physicians and give incorrect information concerning their occupation. This Indian physicians should avoid at all cost. Giving any incorrect information in the visa application form may be construed as a “misrepresentation” or “fraud” and may disentitle that person to receive any immigration benefits at any time in future. Applications for B-2 visas of many Indian physicians are denied not because they are physicians but because they are unable to display their non-immigrant intention in traveling to USA. USA needs Indian Physicians. If therefore Indian physicians would apply for a visitor’s visa after making proper preparations and by displaying their non-immigrant intentions, they would be granted the necessary visitors visa This is the only Immigration Option available to Indian Physicians and they should prepare themselves for meeting with the criteria to receive this category of visa.
